Few topline things to understand about PA’s registration requirements that you might not read elsewhere:
(1) PA’s registration requirements apply to any toys that will be physically sold in PA brick and mortar stores. The regs do not apply to a company that will only be selling to PA residents through e-commerce. However, let’s say that you sell something via your website to a resident in PA and you ship it to them. All good. But, let’s say that that resident later donates the stuffed animal to the Salvation Army. The Salvation Army store is technically a store and they would be barred from selling the stuffed animal. If they do, they would be in violation of PA’s registration law, and would/could get fined for violating it.
(2) You need a registration number for each factory that you source from. If you are sourcing all toys through one factory, then you need to fill out one application and get one registration number. If, however, you source from two different factories, then you need to 2 different registration numbers.
(3) With the application, the PA department needs to receive a sample of each stuffed toy that you plan to sell. That could be a lot of samples! The only exception is that if you have two different stuffed toys that are made with 100% of the same type of materials, then you only need to send the Dept. one of the toys. So, if you are making stuffed animals, and two different models use the same stuffing, same eyes, same nose, same plush material, then you only need to send in one.
(4) They typically do not return samples. They donate them. If however you need to receive them back, then you need to indicate so and include a shipping label + bag/box that covers the costs of both return PICKUP and DELIVERY.
(5) Turnaround time from receipt of samples to you getting your PA license # is anywhere between 2 days and 2 weeks.
I am trying to determine if PA is unique or different in their flammability laws. I’ll read up on these and write a new post on this topic. Regardless of the answer, they did inform me that they no longer actually do flammability testing. They got rid of this department. They only test for safety (seam strength, new stuffing materials, cleanliness, sharp edges, etc. – the usual safety stuff covered by ASTM F93).
